Court Decides in Favor of Lipodissolve Procedure

Kansas doctors and patients to benefit from positive ruling



Sept. 13, 2007 (Overland Park, KS)
A decision was issued late this afternoon by a Shawnee County District Judge allowing Kansas doctors to continue prescribing and administering the lipodissolve procedure. The court action today overturns an August decision by the Kansas Board of Healing Arts which would have prohibited the treatments except in the case of clinical research.

The ruling issued by District Court Judge David E. Bruns today reverts back to an original measure, proposed by the Board in April, which provided for doctors in private practice to administer lipodissolve. Today’s court decision reaffirms the Board’s earlier recommendation by clearing the way for doctors to continue to practice medicine as they see fit.

Plastic surgeon John M. Hiebert, M.D., the petitioner in this action, commended the court decision today. “We believe this to be an excellent and fair ruling, one that will serve the health interests of the people of Kansas,” said Dr. Hiebert. “This decision reinforces the Board’s intent and our fervent desire to elevate the standards of care.”

Hiebert added, “This is an important first step and I look forward to working with the Board to educate and help establish best practices in this area of healthcare.”
